Beachcroft welcomes proposals in Second Issues Paper
The English and Scottish Law Commissions have now published their second Issues Paper, this time dealing with warranties. In their continuing major overhaul of insurance contract law, they propose putting an end to all “basis of the contract” clauses. They will also abolish warranties of past or existing fact in a consumer context, although they may survive in business contracts.
Customer expectation is again the touchstone for the reforms. The perceived mischiefs are that consumers do not understand “basis of the contract” clauses and that breach of warranty can discharge anOnly users who have a paid subscription or are part of a corporate subscription are able to print or copy content.
