Section 69 of the Enterprise and Regulatory Act 2013 amended section 47 of the Health & Safety at Work Act 1974 for accidents occurring after 1 October 2013.

Section 47 stated that a breach of a duty imposed by health and safety regulations shall, so far as it causes damage, be actionable.

This means an employee could recover damages for injuries even
